Terms of Service

1. Agreement to Terms

By creating an account, accessing, or using the services, API endpoints, or developer console provided by Zertru Inc. ("Zertru", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you are entering into these terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity. If you do not agree to these terms, you may not use our services.

2. Description of Service

Zertru provides an intelligent, zero-trust security proxy gateway for AI applications. The service includes the edge proxy layer, real-time prompt sanitation, Named Entity Recognition PII/PHI redaction, analytics dashboards, policy configuration engines, and optional self-hosted software distributions. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

3. Account Registration & Security

To access the service, you must create a Zertru account. You agree to provide accurate, complete information during registration and keep it updated. You are solely responsible for safeguarding the credentials, passwords, and API keys associated with your account. Any unauthorized use of your account or security breach must be reported to us immediately.

4. API Key Usage and Route Security

Zertru provides API keys to authenticate requests routed through our gateway. You must protect these keys. You agree not to:

• Share or distribute API keys to unauthorized third parties.
• Bypass rate limits, system restrictions, or resource quotas set by your pricing tier.
• Use the service for any illegal, abusive, or unauthorized purposes, including hosting malware, scraping data, or circumventing downstream AI provider policies.

5. Fees, Billing, and Subscriptions

Some features are billed on a subscription basis. You agree to pay all fees associated with your selected tier. Billed amounts are non-refundable except as required by law. Pricing is based on monthly request volumes and SLA agreements, and you will be billed in advance or automatically charged based on usage thresholds as specified on our pricing page.

6. Intellectual Property

Zertru retains all rights, title, and interest in and to our software, developer console, documentation, APIs, machine learning models, heuristics, and trademarks. You retain all rights to the prompts, content, and application data routed through our proxy.

7. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, security reliability, or non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, Zertru shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data resulting from your use of the services.

9. Governing Law

These Terms of Service and any dispute arising out of or related to them shall be governed by the laws of the State of California, without regard to conflict of law principles.
